Terms and Conditions
By requesting membership and submitting your details on this membership site you agree that this is a legally binding agreement between you and The Optimal Performance Health and Healing Association. If you do not agree with all of the terms and conditions contained herein, do not submit an application to become a Member of The Optimal Performance Health and Healing Association.
As used herein, The Optimal Performance Health and Healing Association shall include each of their subscribers, agents, directors, officers, employees and assigns. By submitting an application to become a Member of The Optimal Performance Health and Healing Association, you are representing and warranting that you are at least 18 years of age or the legal guardian of a member under the age of 18 and you have reviewed, fully understand and agree to all of the following terms and conditions.
Membership Requirements
You represent and warrant that you have been referred to The Optimal Performance Health and Healing Association by a Member that is currently in good standing.
The Optimal Performance Health and Healing Association reserves the right to reject any membership application for any reason or no reason at all, in its sole discretion.
Fees/Membership Levels
For the Lifetime Adult and Child level of membership, you authorize and agree that your credit card will be charged the amount of the payment option of your choosing on the Membership Application, You agree that your membership will be required in order for you to participate in the services and members of The Optimal Performance Health and Healing Association.
All transactions with The Optimal Performance Health and Healing Association shall be in U.S. dollars. All payments made to The Optimal Performance Health and Healing Association are non-refundable.
Payment of fees to The Optimal Performance Health and Healing Association does not entitle Members to any ownership or equity interest in The Optimal Performance Health and Healing Association.
Information and Confidentiality
The information contained on this site, as well as any other information provided directly or indirectly by The Optimal Performance Health and Healing Association, is for your personal information and education only. None of the information is intended to invite, induce, or encourage any person to make a legal or, medical decision.
The information you receive as a result of your membership in The Optimal Performance Health and Healing Association shall be treated as Confidential Information, whether or not it is labeled as such. You agree not to copy, exploit, sell, distribute or otherwise disclose any Confidential Information to anyone except to other Members of The Optimal Performance Health and Healing Association that are in good standing. You agree that, in the event that you breach any of your obligations with regard to Confidential Information, your membership will be cancelled immediately.
Disclaimers and Warranty
While The Optimal Performance Health and Healing Association hopes to provide its Members with accurate and up-to-date information, we make no warranties or representations as to the accuracy of the information and assume no liability or responsibility for any error or omission in the information. No one shall be entitled to claim that there is a duty to update or correct any such information.
Your use of this site and any other information, products and services provided directly or indirectly by The Optimal Performance Health and Healing Association is at your own risk. The Optimal Performance Health and Healing Association assumes no responsibility, and shall not be liable for any resulting damages to, or viruses that may affect your computer equipment or other property. The Optimal Performance Health and Healing Association does not represent or warrant that use of such information will not infringe on the rights of third parties.
You agree to indemnify, defend and hold harmless, at your sole expense, The Optimal Performance Health and Healing Association from any claim or action brought by a third party relating to (a) your use of the site and/or (b) your breach of the Membership Agreement or the Terms of Use.
Cancellation and Remedies
The Optimal Performance Health and Healing Association reserves the right to cancel your membership at any time for any reason or no reason at all, in its sole discretion.
You may cancel your membership at any time by submitting in writing your request to cancel you membership by mail or email via addresses located in the contact us section of The Optimal Performance Health and Healing Association website.
The Optimal Performance Health and Healing Association reserves the right to change this Membership Agreement from time to time at its discretion and to notify Members of any such changes by posting a notice on the site, posting the new Membership Agreement on the site, sending the new Membership Agreement to the Members, or in any other way that The Optimal Performance Health and Healing Association deems fit. Your continued membership in The Optimal Performance Health and Healing Association after a new Membership Agreement is in place will constitute your agreement to be bound by that new agreement.
